There might also be a free speech argument in Delphina’s plight because texting your mom when you are sick and not in class does not cause a “material disruption.” By the way I know a good lawyer if you need one. ;)

“High school student speech may be regulated, consistent with First Amendment, when (1) speech is school-sponsored, (2) vulgar, lewd, obscene and plainly offensive, or (3) otherwise causes material disruption, is reasonable likely to do so, or interferes with rights of other students.”
